Survivorship Applications
When a property is owned by two or more people as Joint Tenants, the law in Ontario provides for a "Right of Survivorship". This means that if one owner passes away, their interest in the property automatically transfers to the surviving owner(s).
While this transfer happens legally at the time of death, it is not automatically reflected on the property's title. A Survivorship Application is the legal process required to remove the name of a deceased joint tenant from title and transfer ownership to the surviving owner(s). Completing this application ensures the title is accurate and up-to-date, which is a necessary step before you can sell or refinance the property in the future.
Title Transfers
